The purpose of this study was to seek the direction of improvement of the cultural heritage disaster safety legislation. Until recently, the Cultural Heritage Protection Act regulated the preparation of guidelines for cultural heritage disasters and the installation and maintenance of disaster prevention facilities. In the future, it was necessary to provide field-oriented disaster safety experts, monitor disaster risks, operate disaster safety situation rooms, systematize disaster safety information, and promote safety culture for cultural heritage. The urgent matters can be resolved through the revision of the current Cultural Heritage Protection Act, but ultimately, it was intended to present the necessity of enacting a (tentative name) ‘Act for Disaster Risk Management of Cultural Heritage’.
이 연구에서는 문화재 재난 및 안전관리를 위한 법제 개선 방향을 모색하였다. 최근까지 문화재보호법에서는 문화재 재난에 대비한 지침서 마련과 방재시설의 설치와 유지를 중심으로 규율하였다. 앞으로는 방재시설 이외에 현장 중심의 문화재 재난안전 전문인력, 재난의 대비와 대응을 위한 모니터링, (가칭)‘재난안전상황실’의 운영, 문화재 재난안전 정보의 체계화, 문화재 안전문화의 진흥 등이 필요하다고 보았다. 시급한 내용들은 현행 문화재보호법 개정을 통해서 해결할 수 있지만, 궁극적으로는 (가칭)‘문화재 재난안전에 관한 법률’ 제정이 필요함을 제시하고자 하였다.
