Abstract

This study examines the changes in Korea's national heritage legal system following the enactment of ｢the Framework Act on National Heritage｣ from the perspective of systematic coherence. The Act transformed the traditional cultural property system into a national heritage framework by establishing a classification system of cultural, natural, and intangible heritage and introducing value-oriented protection, the right to enjoy national heritage, sustainable preservation and utilization, and comprehensive protection system. However, issues remain regarding the consistency of the classification and protection systems, the coherence of subordinate legislation, and sustainable protection mechanisms. This study suggests that the legal framework should be further refined through systematic improvements to individual statutes and protection systems reflecting the characteristics of each heritage type.

본 연구는 ｢국가유산기본법｣ 제정에 따른 국가유산 법제의 변화를 체계정합성의 관점에서 분석하고 향후 발전 방향을 검토한 것이다. ｢국가유산기본법｣은 문화재 중심의 법체계를 국가유산 체계로 전환하고, 문화유산·자연유산·무형유산의 분류 체계를 확립하는 한편, 단편적인 원형유지원칙과 동결보존 중심의 관리 체계를 탈피하여 가치 중심의 보호, 국가유산 향유권, 지속가능한 보존·활용, 포괄적 보호 등의 새로운 이념을 제시하였다는 점에서 의의가 있다. 반면 국가유산 분류 및 보호 체계의 정합성, 하위 법령 간의 연계, 지속가능한 보호수단 등은 보완이 필요한 과제로 확인되었다. 앞으로 ｢국가유산기본법｣의 제정 취지와 규정을 반영한 개별 법률의 정비와 유형별 특성을 고려한 다양한 보호 체계의 발전이 요구된다.
