Abstract
This study analyzes, at the level of individual provisions, how the Installation Standards for Basic Living Facilities of National Folklore Cultural Heritage (Notice No. 2024-63) are aligned with disaster-prevention requirements. The text of the notice was decomposed into 42 provision units, each coded by seven regulation types and five disaster-prevention categories, and then classified into four alignment grades: aligned (C1), partially aligned (C2), regulatory gap (C3), and potential conflict (C4). Conditional permission was the most frequent regulation type (15 units, 35.7%), and fire safety was the most frequent disaster-prevention category (19 units, 45.2%). Potential conflict was the largest alignment grade (15 units, 35.7%). Among the 19 fire-safety provisions, 12 (63.2%) were classified as potential conflict, markedly higher than the proportion for the other categories (3 of 23, 13.0%; Fisher's exact test, p=0.001). By contrast, provisions concerning moisture and biodeterioration included three aligned units and no potential conflict. All five mandatory provisions required concealment of externally exposed facilities with traditional materials, and all were classified as potential conflict. In addition, 12 disaster-prevention elements, including fire detection and alarm devices, fire extinguishing equipment, and electrical and gas safety requirements, were not regulated by the notice. The contribution of this study lies in identifying, provision by provision, where the installation standards organized around authenticity preservation diverge from disaster-prevention requirements.
본 연구는 「국가민속문화유산 생활기본시설 설치기준」(문화재청고시 제2024-63호)이 방재 관점에서 어떠한 정합성 구조를 가지는지 조문 단위로 분석하였다. 고시 본문을 42개 조문단위로 분해하고, 각 단위를 7종의 규율유형과 5종의 방재항목으로 코딩한 뒤 정합(C1)·부분정합(C2)·규율공백(C3)·잠재상충(C4)의 4등급으로 판정하였다. 분석 결과 조건부허용형 조문이 15개(35.7%)로 가장 많았고, 방재항목별로는 화재안전 관련 조문이 19개(45.2%)로 최대 비중을 차지하였다. 정합성 판정에서는 잠재상충이 15개(35.7%)로 가장 많았으며, 화재안전 조문 19개 중 12개(63.2%)가 잠재상충으로 분류되어 그 외 항목과 뚜렷한 차이를 보였다(Fisher's exact test, p=0.001). 반면 습기·생물열화 항목은 정합 3개, 잠재상충 0개로 상대적으로 정합적이었다. 강행적 의무규정 5개는 모두 외부 노출시설의 전통재료 차폐를 요구하는 조항이었고 전부 잠재상충에 해당하였다. 또한 화재감지·경보설비, 소화기구, 전기·가스설비 안전기준 등 12개 방재 요소는 고시에 규율되어 있지 않았다. 본 연구는 원형보존을 축으로 구성된 설치기준과 방재 요구가 어긋나는 지점을 조문 단위로 제시하였다는 데 의의가 있다.
