A Comparative Study of National Heritage Legislation on Disasters by Country

Abstract
National heritage is a crucial asset embodying a nation's history, culture, and artistic value, and it is a precious legacy that must be passed down to future generations. However, this national heritage is facing serious threats due to recent climate change and the frequent occurrence of natural disasters. In particular, damage to national heritage during disasters is more than just material loss; it is seriously significant in that it can severely damage a nation's identity and cultural continuity. Accordingly, various countries around the world are establishing various legal and institutional mechanisms to protect national heritage from disasters. This paper aims to analyze the current state of legal systems in each country and seek effective disaster preparedness and response measures through a comparative study of national heritage legislation on disasters.

국가유산은 한 국가의 역사, 문화, 예술적 가치를 담고 있는 중요한 자산으로서, 후대에 계승되어야 할 소중한 유산이다. 그러나 최근 기후 변화와 자연재난의 빈번한 발생으로 인해 이러한 국가유산이 심각한 위협에 직면하고 있다. 특히, 재난 발생 시 국가유산의 훼손은 단순한 물질적 손실을 넘어 국가의 정체성과 문화적 연속성에 심대한 타격을 줄 수 있다는 점에서 그 심각성이 크다. 이에 따라 세계 각국은 재난으로부터 국가유산을 보호하기 위한 다양한 법적, 제도적 장치를 마련하고 있다. 본 논문에서는 재난에 관한 국가유산 법률의 비교 연구를 통해 각국의 법률 현황을 분석하고, 효과적인 재난 대비 및 대응 방안을 모색하고자 한다.
